Objection Procedures based on the Guidelines for Environmental and Social Considerations

JICA proclaimed the new ‘JICA Guidelines for Environmental and Social Considerations’ on April 1st, 2010, which comes into effect on July 1st, 2010. Coincidentally JICA also established the new ‘Objection Procedures based on the Guidelines for Environmental and Social Considerations’. The new Objection Procedures have consolidated two Objection Procedures that former JICA and former JBIC had had respectively into a single set of procedures.
Objectives of the Objection Procedures are (1) to investigate whether or not JICA has complied with the Guidelines based on an objection and report the results to the President in order to ensure JICA’s compliance with the Guidelines; and (2) to encourage dialogues between the parties concerned based on their consent in order to assist early resolution of disputes concerning specific environmental and/or social problems caused by the project on which JICA had not complied with the Guidelines.

When JICA’s non-compliance with the Guidelines regarding the project for which JICA provides cooperation has caused actual damage or are likely to cause damage in the future, two or more residents of the country could submit an objection. JICA appoints Examiners for the Guidelines who are under the direct control of the President and independent of line departments in order to achieve the above-mentioned two objectives in response to the objection.

Examiners for the Guidelines

On July 1st, 2010, JICA appointed two Examiners.
