Cabinet Approved the drafts of Law on Non-litigation Civil Procedures and Law on the Procedures in Action relating to Personal Status

The Cabinet approved the draft of Law on the Procedures in Action relating to Personal Status on 19 February 2010 and the draft of Law on Non-litigation Civil Procedures on 5 March 2010. Those drafts were prepared by the Japanese Working Group on the Code of Civil Procedure and then discussed and modified in the Cambodian Committee meetings so as to finalize the drafts.

The Law on the Procedures in Action relating to Personal Status is a special law of the Code of Civil Procedure that stipulates special procedures for resolving disputes in marriage relationship, or parents and children relationship. Actions related to personal status are defined as actions that make an effect of creation or dissolution of personal status through final and binding judgment, such as divorce actions, actions for denial of paternity, actions for acknowledgement by father, and so on..

The Law on Non-litigation Civil Procedures is a law to establish procedures for seeking court orders or dispositions, such as commencement of general guardianship, approval of child adoption, probate of a will, and so on. The Civil Code endows the courts with certain authorities to render necessary orders or dispositions in the cases which do not have two adversarial parties (i.e., plaintiffs and defendants), and which should be resolved in easier and quicker way than lawsuits..

Those drafts will be submitted to the National Assembly and the Senate for the deliberation.
