Enactment of the Law on the Procedure for Litigation Relating to Personal Status and the Law on Non-Litigation Civil Procedure

The draft of the Law on the Procedure for Litigation Relating to Personal Status was approved by the National Assembly on the 26th of April and approved by the Senate on the 20th of May. Afterwards, the King of Cambodia made his signature upon the law for its promulgation. Through these procedures it was enacted as a law.

The draft of the Law on Non-Litigation Civil Procedure was approved by the National Assembly on the 9th of June and approved by the Senate on the 25th of June. Afterwards, the King also made his signature upon the law for its promulgation.

These laws were initially drafted by the Japan's Supporting Group, and then discussed and finalized by the Committee Meeting of Ministry of Justice of the Kingdom of Cambodia.

The Law on the Procedure for Litigation Relating to Personal Status is a special law of the Code of Civil Procedure (CCP) that stipulates jurisdictions and special procedures for personal status litigations such as marital disputes, or paternity and maternity disputes. The Law on Non-Litigation Civil Procedure stipulates the jurisdictions and procedures for rendering necessary court rulings in some non-litigation cases such as the commencement of general guardianship or curatorship, declaration of disappearance, which are stipulated in the Civil Code (CC).

As such, these are necessary and important laws supplementary to the CC and the CCP.

These laws will begin to apply at the same time as the application of CC. Thus, the Ministry of Justice is preparing for publishing these laws in a booklet and will prepare for dissemination seminars.
