Launching of QnA Book on Regulation Formation

February 25, 2025, the Ministry of Law of the Republic of Indonesia and JICA published a revised edition of a Q&A book for legal drafters. This book explains important points when drafting laws and regulations in an easy-to-understand Q&A format for practitioners, which is expected to realize high-quality drafting of laws and regulations.

This ceremony was attended by the Minister of Law, Mr. Supratman Andi Agtas; Vice Minister, Mr. Edward Omar Sharif Hiariej; and Director General of Legislation, Mr. Dhahana Putera from the Indonesian side. Form Japan side, Mr. Katsuro Nagai, Deputy Chief of Mission from Embassy of Japan for Indonesia; Ms. Sachiko Takeda, Chief Representative of JICA Indonesia also attended. While, Mr. Ryota Tatemoto from International Cooperation Department, Ministry of Justice of Japan was present online.

This “QnA Book on Regulation Formation" is a result of "Project on Intellectual Property Rights Protection and Legal Consistency for Improving Business Environment" which implemented since December 2015 to September 2021, and "Project for Efficient and Fair Disputes Resolution Mechanism and Legislative Drafting Capacity Development for Improving Business Environment " which started since October 2021. Previously, the Q&A Book on Regulation Formation for the level of central regulation published in December 2019, and the similar book for regional level published in July 2022.

Legal drafter is a functional professional position who is in charge of drafting and reviewing laws and regulations and one of the goals of the ongoing cooperation project is to improve the consistency of law in Indonesia. This QnA book is made to answer common questions​ submitted by the legal drafter in charge to compile and to review regulation so that every legal drafter will have the same understanding on the each issues and regulation​. In this version, there are some changes, reflecting some changes in laws and regulations which occurred since the previous edition was published. This revision is results from collection opinions of officials in the Ministry of Law and many working group meetings.

It is believed that inconsistency of law is caused by various possible factors​, and it is difficult to overcome. However, to increase business environment in Indonesia, JICA will make an effort overcome it through this project.
