1. Basic Concept

As pertains to General Data Protection Regulation 2016/679 of April 27, 2016 (hereafter, “the GDPR”) of the European Union (hereafter, the “EU”) and other laws concerning protection of personal information, the Japan International Cooperation Agency (hereafter “JICA”) collects personal data of users of the website of JICA (hereafter "this site") to the extent necessary for seamless operation of services provided on this site. In its handling of personal data, JICA strictly observes the requirements of Japan’s “Act on the Protection of Personal Information” (Act No. 57 dated May 30, 2003) (hereafter, “the APPI”) and its own internal “Bylaws for the Implementation of Personal Information Protection” (Bylaws (Gen) No. 11 dated April 1, 2005), and only uses information it collects within limits as set forth below so as to fulfill requirements of the GDPR and related laws and regulations.

2. Scope of application

This Privacy Policy applies to the processing of personal data implemented from this site, and all collection forms and other media related to it. However, JICA is not responsible for the content of external websites linked from this site.
Personal data as defined in the GDPR consists of any information that directly or indirectly identifies the user as a natural person.
JICA reserves the right to amend the Privacy Policy, in particular to take account of any changes in the applicable law. Therefore, JICA recommends the user to regularly consulting this page, the date of the last online publication of which will appear at the top of this document.

3. Personal Information Collected and Purposes for Which It Is Used

(1) When using this site, there is in principle no need to provide any personal data of the user, such as name and address. However, the user is required to register personal data, such as name, organization name, phone number, email address and so on, in order to use the following services that are provided through this site. JICA collects the personal data for the purposes described below, and processes the personal data according to the legal basis detailed below.

The purpose of using personal data will be explicitly stated, and the user’s consent for its use will be obtained each time.

(2) JICA collects and processes personal data with the consent of users or as required by its legitimate interests (providing and improving services) within the scope necessary to seamlessly implement services provided by this site and as a reference for JICA operations. The personal data collected may be shared among departments in JICA depending on the content. The personal data may also be made accessible to JICA’s technical service providers, for the strict needs of their mission and in accordance with JICA’s instructions, in particular for the hosting and maintenance of this site.

(3) This site automatically collects information such as internet domain names, IP addresses and page views for the purpose of service improvement. To improve services provided, Google Analytics, an access analysis tool from Google, is installed on this site. Google Analytics uses a cookie (*) to track behavioral data on the user, as well as to measure user attributes such as age, gender and interests acquired from Google's advertisement network and other services. To disable Google Analytics, you can apply the Google Analytics Opt-out Browser Add-on provided by Google.

Also, you can disable the cookie function by changing your browser settings; however, please note that, by doing so, part of the services may not be available.

(*) Cookies are a mechanism to temporarily store data on a user's computer through a browser when a user visits a website. Information on the user's device and the number of visits to the site are recorded in a cookie and are used to identify the user when they visit this site.

4. Provision of Information Handled

Except in case of request for disclosure based on the GDPR, APPI or related law or regulation, unauthorized access, illegal threats or other special circumstances, JICA will neither use any information collected for any purpose other than those stated in paragraph3 above, nor provide it to any third party.

However, JICA may publicize statistically processed and/or anonymized data or opinions with respect to information on access to this site, proposals and opinions to JICA, and personal attributes pertaining to the information.

5. Data Protection Measures

The personal data collected by JICA for the purposes listed in paragraph 3 above is protected by appropriate technical and organisational measures against the risks of unauthorised access to or disclosure of the personal data, in accordance with the applicable laws.

In addition, JICA may outsource operation of this site. In such case, the outsourcer must also comply with GDPR, APPI and related laws, protect data against breaches, losses and other harm, and take all appropriate measures to provide for proper management of data.

6. Disclosure, Correction and Suspension of Use of Personal Data

(1) According to the GDPR provisions and other laws and regulations applicable to each user, each user have the following rights over his or her personal data:

  • The right to obtain confirmation as to whether the personal data concerning the user is or is not being processed and, when it is, the right to access to this data, as well as the right to have information on this processing;
  • The right to rectify inaccurate data;
  • In certain specific cases, the right to obtain the erasure of his or her personal data;
  • The right to portability of the data;
  • The right to restrict processing in some cases;
  • The right to object to the processing of the data, for reasons relating to the user’s particular situation, or, regardless of the user’s particular situation, the right to object to the use of the data for marketing purposes; and
  • The right to withdraw consent at any time, without affecting the lawfulness of the processing if it is based on the user’s consent.

(2) When a user of JICA’s website requests disclosure, erasure, correction, or suspension of use of their personal data, JICA will disclose, erase, correct or suspend use of the personal data as appropriate to the circumstances of the request. To submit such a request, please refer to “Bylaws for the Implementation of Personal Information Protection.”

(3) According to the laws and regulations applicable to each user, a users of this site has the right to submit a complaint regarding JICA’s handling of personal data to his or her competent authority with jurisdiction over data protection. JICA would appreciate the opportunity to respond to concerns of the person considering a complaint regarding his or her rights by contacting JICA through the link provided in paragraph 10 below before submitting such complaint.

7. Consent-based Handling of Personal Data and Withdrawal of Consent

(1) By indicating agreement with this Privacy Policy, the user is giving consent to the use of personal data by JICA as indicated by this Privacy Policy, and JICA will make use of such personal data based on the user’s consent. However, the user may withdraw their consent for use of personal data at any time. Furthermore, use of the services provided through this site by a child who has not attained the age of 16 years (or the age for minors as set forth by individual nations’ laws pertaining to the GDPR or other laws applicable to the user) requires the consent of the child’s parent or guardian, and use of the services is only permitted with the explicit consent of the parent or guardian.

(2) Users who register to receive email magazine mailings may cancel their subscription for such mailings at any time. They may also change or correct previously registered information by registering new information.

8. Period of Data Maintenance

JICA will maintain and utilize personal data only for the purposes set forth under paragraph 3 above, and for other allowable related purposes. JICA will promptly delete or anonymize such personal data once it is no longer required for those purposes.

9. Transfer of Personal Data Outside Europe

JICA may transfer and use personal data outside of the European Economic Area (EEA)and countries subject to the GDPR for the purposes set forth above. In such cases, personal data may be transferred to countries or regions where data rights similar to those of the GDPR are not recognized. When transferring personal data to a country outside of Europe (including Japan), JICA will assure sufficient measures for the protection of personal data by means of Standard Contractual Clauses (including the standard set forth in Article 71(1) of the APPI, and item 1 of Article 46 of the Enforcement Rules for the APPI) designed to provide protections equivalent to those provided by the GDPR, and other methods provided by the GDPR and the APPI.

11. Notes

(1) Some social networking services (SNS) provide “buttons” that when included on other websites will cause personal data such as user IDs and information about sites visited to be automatically transmitted to the SNS even if the button is not clicked.

(2) JICA may change all or part of this Privacy Policy at its discretion. Changes in this Policy will be announced on this site. Notification of significant changes will be provided in an easily-understood form through this site where these services are provided.
