Launching of the Guidebook for Intellectual Property Rights Dispute Settlement for Judges in Indonesia - Towards Better Legal Predictability in the Business World

On February 27, 2025, a ceremony was held in Jakarta to launch the second Guidebook for Intellectual Property Rights Dispute Settlement for Judges in Indonesia on Copyright. This guidebook is one of the products of JICA's technical cooperation "Project on Efficient and Fair Dispute Settlement Mechanism and Capacity Building for Drafting Laws and Regulations to Improve Business Environment" and previous cooperation projects.
The ceremony was attended by the Chief Justice of the Supreme Court, Mr. Sunarto; and the Deputy Chief Justice of the Supreme Court, Mr. Suharto, from the Indonesian side, as well as Mr. Katsuro Nagai, representative of the Japanese Embassy in Indonesia; Mr. Kenji Okamura, Senior Representative of JICA Indonesia; and several other parties from the Japanese side and was held very lively.
So far, under JICA's cooperation, the Indonesian Supreme Court and JICA's experts who are Japanese judges have collaborated to produce a collection of Intellectual Property Rights-related judgments from Japanese and Indonesian courts. Following this, a Trademark-related Guidebook was published in January 2024 as a guide for judges, particularly commercial judges who handle trademark cases.
The Copyright Handbook published this time explains the overall picture of the complex Copyright Law in an easy-to-understand manner, and organizes the types of rights, duration, limitation provisions of copyright, and so on, based on the things that need to be considered when handling a case. The guidebook also contains extensive information on the procedural aspects of copyright dispute resolution, and it is hoped that judges in Indonesia handling copyright cases will find this guidebook helpful in resolving their cases.
In order for private enterprises to operate smoothly in Indonesia, it is necessary to ensure the application and implementation of clear and stable laws, in addition to the proper enforcement of laws. Through this cooperation, JICA will improve the logic of judgment and court procedures in business-related cases in Indonesia by providing training and office reference materials for judges and will promote activities to contribute to the development of a business environment in which private companies, including Japanese companies, can develop their businesses with peace of mind.

Project Details
The project aims to improve the drafting and reviewing capabilities of drafters in Indonesia by improving training content to improve drafters’ ability to ensure consistency of laws and regulations and by providing a Q&A and reference book for judges in business-related cases. The project also aims to improve the logic of decisions in business-related cases and improve court procedures in Indonesia. This will contribute to increasing legal predictability in the business world.
