The Third Seminar on the Civil Code

The third seminar on the Civil Code was held in CJCC (Cambodia Japan Cooperation Center) from Nov. 15 to 22, 2011 by MOJ and JICA. This seminar aimed to disseminate the CC before its application in the end of this year as same as the first and second seminars. Three law professors who who are the members of Japanese Advisory Group on the CC were invited from Japan to provide lectures. The seminar had in total around 100 attendants, who were judges from all over Cambodia, officials of Ministry of Land Management, Urban Planning and Construction, officials of MOJ, lawyers and students.

The topics of this seminar were agency, assignment of claims and guaranty. Though each of them is very important mechanism for development of Cambodia, agency and guaranty had not been fully understood and utilized very well. Assignment of claims is a very new concept which "Decree No. 38D referring Contracts and other Liabilities" does not mention and few people have had an idea of assigning claims. Japanese professors explained the basic structure of each system showing case examples in detail. Each topic drew close attention from the participants, and not only judges but also lawyers asked many questions during lectures.

The third comprehensive seminar on the CC will be held followed by the ceremony of a large scale with the attendance of the Vice Prime Minister Sok An, commemorating the application of the CC is planned on December 21(the application date of the CC). A seminar on security rights, especially focusing on the transition from gage to hypothec, which is one of the main features of the new CC, will be also held the next week. MOJ and JICA will continue the efforts to disseminate the new CC and to make it take root in Cambodia.
